Passport Terms and Conditions of Use

Version 1.1 – October 2024

1. Introduction

Passport is an iOS mobile application that lets users record and visualize the countries they have visited through an interactive map and a searchable destination list. These Terms and Conditions govern the use of the application and of any content, service, or functionality offered through it.

By downloading, installing, or using Passport, you agree to these Terms and Conditions. If you do not agree, you must refrain from using the application.

2. Permitted use

  1. Passport is designed for personal and non-commercial use. You may use it to manage your travel history and consult information about countries within the app itself.
  2. You may not use the application for illegal activities, defame third parties, distribute malicious content, or infringe the rights of others.
  3. You may not decompile, disassemble, or reverse engineer the application except where such actions are permitted by applicable law.

3. Registration and notifications

  1. Passport does not require the mandatory creation of an account for its core functionality. However, certain features may require additional authentication when enabled in future versions.
  2. By enabling push notifications, you agree that Passport will use Firebase Cloud Messaging (FCM) to send relevant alerts related to the application. A device token and the associated language code are stored to deliver messages.
  3. You can disable notifications at any time from the iOS system settings.

4. User-generated content

  1. Data about visited countries, notes, and dates that you add are stored locally on your device through SwiftData. You are responsible for ensuring the accuracy of that information.
  2. Passport does not verify the accuracy of user-provided data and assumes no responsibility for any loss or damage resulting from its use.

5. Third-party services

  1. The application integrates MapLibre for rendering the world map. Use of the map is subject to the MapLibre license terms.
  2. Passport may include links or integrations with external services (for example, invite links through universal links hosted on Firebase Hosting). We are not responsible for the content or practices of those services.

6. Intellectual property

  1. Passport and its graphic elements, logos, and names are the property of its developer and are protected by applicable intellectual property laws. All rights are reserved.
  2. You may not reproduce, distribute, publicly display, translate, modify, or create derivative works of the application or any portion of it without the prior written consent of the rights holders, unless mandatory statutory provisions allow such use.
  3. Nothing in these Terms shall be construed as granting any license or transfer of intellectual property rights beyond what is strictly necessary for you to use the app as provided. For statutory disclosures, please refer to our Legal Notice (Impressum).

7. Limitation of liability

  1. Passport is provided "as is" and "as available." No express or implied warranties are given regarding its performance, availability, or fitness for a particular purpose.
  2. To the extent permitted by law, the developer shall not be liable for indirect, incidental, special, or consequential damages arising from the use or inability to use the application.

8. Modifications

We reserve the right to modify these Terms and Conditions at any time. Material changes will be communicated through the application or other official channels. Continued use of the application after changes have been published constitutes acceptance of those changes.

9. Governing law and jurisdiction

These Terms shall be governed by and construed in accordance with the laws in force in the developer's country of residence. Any dispute shall be submitted to the competent courts of that jurisdiction, unless otherwise required by law.

10. Contact

For questions about these Terms and Conditions, you can contact the Passport team via the email address provided in the app store listing or in the official project repository.
